Does anyone know what tenants rights are in California?
We are renting a house of some people who are in foreclosure, but are not communicating with us, we know nothing and I fear that we have the people at the bank at our door at any time. What are our rights in this situation. We have lost our jobs and can not afford and really need to know our rights and the procedures they must follow to get us
The real question I think most Americans are asking today is, does anyone know someone in California who is not a fruit or a nut? But the answer to your question is basically very simple. Who does the house belong? The person or entity that is controlled by what happens to the house, more or less. It would be an easy assumption to take if the house is in foreclosure, people that are renting the house are not the owners. No doubt they are buying and are behind the note. In that case the bank or credit institution who holds the title of the property is the rightful owner and say they live or not live at home. If you want to try to contact them (the owners) and explain your situation. You may be allowed to live there and pay rent. However, it is your home and maybe you need think about getting home. All this is quite simple really. It is a shame that many people today can not seem to grasp the idea of property and / or responsibility staff in the purchase or lease of property of another person.
